These Terms of Use (the Terms) govern your access to and use of the Kokomo Scanner mobile application, browser application, public incident pages, and related services (together, Kokomo Scanner or the Service).
Please read these Terms and the separate Community Guidelines before creating an account, commenting, replying, or uploading a photo. By creating an account or choosing to participate, you agree to these Terms and the Community Guidelines. If you do not agree, you may still use any guest features that Kokomo Scanner makes available, but you may not create or submit community content.
1. What Kokomo Scanner provides
Kokomo Scanner shares timely local incident information, including information heard over public-safety radio systems. The Service may also provide personalized feeds, notifications, public comments, photos, sharing tools, and account features.
Kokomo Scanner is an independent community-information service. It is not a law-enforcement agency, fire department, emergency medical service, emergency dispatch center, or government agency.
2. Emergencies and initial dispatch information
Do not use Kokomo Scanner to request emergency help. Call 911 or the appropriate local emergency service. Do not delay contacting emergency services because of anything displayed—or not displayed—by Kokomo Scanner.
Scanner traffic generally reflects initial dispatch information. It may be incomplete, misunderstood, unconfirmed, delayed, or later determined to be incorrect. Responding officers, firefighters, emergency medical personnel, and other responsible authorities investigate calls and determine what occurred. Incidents may change as more information becomes available.
You are responsible for how you use information from the Service. Do not rely on Kokomo Scanner as your only source for decisions involving personal safety, travel, health, legal rights, or property.
3. Who may use an account
You must be at least 13 years old to create an account. If you have not reached the age of legal majority where you live, you must have permission from a parent or legal guardian to use an account.
You may not use the Service if doing so would violate applicable law or if Kokomo Scanner has suspended or ended your access.
4. Your account
When creating or maintaining an account, you agree to:
- provide accurate account information;
- keep your email address current and complete required email verification;
- protect your password and not share access to your account;
- promptly report suspected unauthorized access; and
- accept responsibility for activity performed through your account unless you have reported that the account was compromised.
Do not impersonate another person, create an account to evade a restriction, or use misleading account information. Kokomo Scanner may require reasonable steps to confirm account ownership or eligibility.
5. Community content
Community content means comments, replies, photos, report details, and other material that a community member submits through the Service.
You keep any ownership rights you have in your community content. You are responsible for that content and must have the rights and permissions needed to submit it. Do not upload content merely because it is available elsewhere.
By submitting community content, you give Kokomo Scanner a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute that content only as reasonably needed to operate, secure, moderate, improve, and provide the Service. This license also allows Kokomo Scanner to preserve limited copies when reasonably needed for moderation, security, legal compliance, or conversation context. It ends when the content is deleted except for material that must reasonably remain in protected records, backups, or existing conversation context.
Community comments and photos may be visible to anyone who can view the related incident, including guests. Review everything before submitting it. Do not post private information, sensitive details, or photo metadata that you do not want others to see.
6. Community Guidelines
The Community Guidelines are part of these Terms. They apply to every comment, reply, photo, report, and other community interaction.
Among other things, the Guidelines prohibit illegal content, threats, harassment, hateful or discriminatory conduct, sexual exploitation, content that endangers children, ridicule of victims or patients, trolling, harmful rumors, private identifying information, unauthorized advertising, and other objectionable or disruptive content.
Participation is a privilege. Access to public information may remain available even when an account loses the ability to comment or upload photos.
7. Reporting and blocking
Use the clearly labeled Report action to alert Kokomo Scanner to content that may violate these Terms or the Community Guidelines. Reports are not public. Submitting a report does not guarantee a particular outcome, but Admins or Owners will review reports and take action they consider appropriate.
Use the separate Block member action when you do not want to see eligible content from a particular community member. Blocking changes what the blocking member sees. It does not remove content for everyone, erase safety or moderation records, or prevent Kokomo Scanner staff from reviewing the content.
Do not misuse reporting or blocking tools to harass another person, overwhelm staff, or retaliate over a good-faith disagreement.
8. Moderation and enforcement
Kokomo Scanner may review, restrict, hide, remove, preserve, or disclose content when reasonably necessary to operate the Service, enforce these Terms, protect people, comply with law, or investigate abuse.
Depending on the circumstances, Kokomo Scanner may:
- remove a comment, reply, or photo;
- temporarily or permanently restrict community participation;
- suspend or delete an account;
- preserve relevant content and records;
- notify an appropriate service provider or authority when required or reasonably necessary; or
- take no action when a report does not establish a violation.
Admins and Owners are authorized to enforce the rules without conducting a public argument or negotiation in the comment thread. Kokomo Scanner may act immediately in serious cases and may consider context, severity, history, and repeated conduct. It is not required to use progressive discipline or provide advance notice before every action.
Questions about an account restriction may be sent to admin@kokomoscanner.com. Kokomo Scanner is not required to debate moderation decisions publicly or respond to repeated or abusive messages.
9. Prohibited uses
You may not:
- violate law or encourage illegal, dangerous, fraudulent, or harmful conduct;
- interfere with emergency operations or encourage others to approach an active incident scene;
- threaten, stalk, bully, harass, exploit, or endanger another person;
- submit child sexual abuse material or any content that sexually exploits, abuses, grooms, traffics, or endangers a child;
- access, probe, damage, overload, disrupt, or bypass the Service or its security controls;
- use automated methods to scrape, collect, copy, or submit content without written permission;
- distribute malware or attempt to obtain another person's password or account information;
- impersonate Kokomo Scanner, its staff, a public-safety agency, or another person;
- use the Service to advertise, solicit, spam, or promote an unrelated page, group, product, business, or service without permission; or
- help another person evade a restriction or violate these Terms.
10. Official Kokomo Scanner content
The Kokomo Scanner name, logo, design, software, and official incident content are owned by Kokomo Scanner or used with permission and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.
You may use the Service's built-in sharing tools to share public incident links for personal, noncommercial purposes. You may not remove attribution, falsely suggest an endorsement, operate a confusingly similar service, or reuse Kokomo Scanner content in a misleading or unlawful way.
If you believe content on the Service infringes your rights, contact admin@kokomoscanner.com with enough information for Kokomo Scanner to review the concern.
11. Third-party services
The Service may use or link to third-party services, including Supabase, Cloudflare, Firebase, Apple, Google, and Facebook. Those services may have their own terms and privacy practices. Kokomo Scanner is not responsible for a third-party service's independent content, availability, or actions.
12. Availability and changes
Kokomo Scanner may add, change, suspend, or discontinue any part of the Service and may correct, edit, archive, or remove incident information. The Service may occasionally be delayed or unavailable because of maintenance, provider failures, connectivity, safety concerns, or events outside Kokomo Scanner's control.
Kokomo Scanner does not promise that every incident will be posted or that any post or notification will arrive within a particular time.
13. Privacy
The Kokomo Scanner Privacy Policy explains how information is collected, used, shared, retained, and deleted. The Privacy Policy is separate from these Terms.
14. Ending your use and deleting an account
You may stop using the Service at any time. Eligible signed-in members may delete their account through Account > Profile > Delete my account in the app or browser.
Account deletion removes sign-in access and handles account information as described in the Privacy Policy. Public contributions and limited security, moderation, or audit records may remain in anonymized or restricted form when needed for conversation context, service integrity, safety, dispute resolution, or legal obligations.
Sections that by their nature should continue after account deletion or the end of access—including intellectual-property, record-preservation, disclaimer, limitation-of-liability, and dispute provisions—will remain in effect.
15. Disclaimers
To the fullest extent permitted by law, the Service is provided as is and as available. Kokomo Scanner disclaims warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, availability, and uninterrupted or error-free operation.
Kokomo Scanner does not endorse community content and is not responsible for the accuracy, completeness, or reliability of content submitted by community members.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
16. Limitation of liability
To the fullest extent permitted by law, Kokomo Scanner and its Owners, Admins, volunteers, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, use, or opportunities, arising from or related to the Service.
To the fullest extent permitted by law, Kokomo Scanner's total liability for a claim related to the Service will not exceed the greater of the amount you paid Kokomo Scanner for the Service during the 12 months before the claim or 100 U.S. dollars.
These limitations do not apply where applicable law does not permit them.
17. Responsibility for your conduct
To the fullest extent permitted by law, you agree to be responsible for claims, losses, and reasonable costs arising from your unlawful use of the Service, your community content, or your material violation of these Terms or another person's rights.
18. Governing law
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any legal proceeding relating to these Terms or the Service must be brought in a state or federal court with jurisdiction in or over Howard County, Indiana.
19. Changes to these Terms
Kokomo Scanner may update these Terms as the Service changes. The updated Terms will show a new effective date. When a change materially affects community participation or legal rights, Kokomo Scanner may provide additional notice or require renewed acceptance before allowing another comment, reply, or photo upload.
20. General provisions
If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. These Terms, the Community Guidelines, and any policies expressly incorporated here form the agreement between you and Kokomo Scanner concerning the Service.
